Official Promotional Rules for the Nebraska Lottery Wheel of Fortune Second-Chance Promotion

1.         Overview:

1.1       Promotional Times and Dates: This promotion runs from 5:00 a.m. CT on Monday, April 25, 2016, through 11:59 p.m. CT on Tuesday, August 9, 2016.

1.2       Three (3) semifinalist drawings will be held:

            - June 1, 2016, to select three (3) semifinalists;

            - July 6, 2016, to select three (3) semifinalists; and

            - August 10, 2016, to select three (3) semifinalists.

2.         Prizes: There are nine (9) prizes for this promotion for the nine (9) randomly selected semifinalists as described below.

2.1       The nine (9) semifinalists for the Wheel of Fortune Second-Chance Promotion will be entered into a Grand Prize contest to be held on August 28, 2016, at the Nebraska State Fair in Grand Island, Nebraska. The prize each semifinalist receives will be deter­mined in accordance with the Grand Prize contest rules, which rules will be made available to each semifinalist prior to the contest. At this Grand Prize contest, the Nebraska Lottery will select:

a)         One (1) Grand Prize winner, who will receive a Wheel of Fortune VIP Trip to Los Angeles (with a chance to be randomly selected to play on the Lottery-Players only, non-broadcast show with Pat Sajak and Vanna White), plus $12,000 cash. This is a total approximate prize value of $18,400. Additional details of the prize contents can be found in the Trip Prize Fulfillment sections 3 and 3.1 below.

b)         One (1) Second Prize winner, who will receive a Wheel of Fortune VIP Trip to Los Angeles (with a chance to be randomly selected to play on the Lottery-Players only, non-broadcast show with Pat Sajak and Vanna White), and $8,000 cash. This is a total approximate prize value of $14,400. Additional details of the prize contents can be found in the Trip Prize Fulfillment sections 3 and 3.1 below.

c)         Seven (7) winners of runner-up prizes, consisting of each semifinalist who did not win the either of the Wheel of Fortune VIP Trip prizes. The non-trip prize winning semifinalists will be selected as third place to ninth place winners. The semifinalists will receive a cash prize, as detailed below.

 

            Runners-up—Prizes:

                        3rd place $7,000 cash;

                        4th place $6,000 cash;

                        5th place $5,000 cash;

                        6th place $4,000 cash;

                        7th place $3,000 cash;

                        8th place $2,000 cash; and

                        9th place $1,000 cash.

 

3.         Trip Prize Fulfillment: Wheel of Fortune VIP Trip (VIP trip) fulfillment shall include the scheduling and coordination of all travel, hotel accommodations, and ground transfers as provided below. VIP trips are provided by IGT, which shall be responsible for VIP trip prize fulfillment. If a Wheel of Fortune VIP Trip winner (trip winner) is unable to attend the Non-Broadcast TV Show, a designee appointed by the trip winner may fill in as a proxy at the Non-Broadcast TV Show. In the event that a trip winner is unable to appoint a proxy, an IGT representative shall fill in as a proxy for the trip winner at the Non-Broadcast TV Show. Any cash prize(s) won by any such proxy shall be awarded to the trip winner who appointed the proxy or on whose behalf the proxy was appointed.

3.1       The Wheel of Fortune VIP Trip consists of the following:

A.        The Wheel of Fortune VIP Trip includes: roundtrip airfare for a Wheel of Fortune VIP Trip winner and one guest. Up to two (2) coach class tickets shall be booked on a major airline, as defined by the Federal Aviation Administra­tion, from a U.S. airport to LAX airport. Travel costs to and from the U.S. airport of initial departure will be the responsibility of the winner;

B.        One (1) hotel room for four (4) nights, and five (5) days deluxe accommodation (double occupancy, room, and room tax only) at a Los Angeles hotel;

C.        All ground transfers between LAX and the hotel. Ground transportation to and from Sony Studios and the hotel;

D.        One thousand dollars ($1,000) spending money;

E.         Welcome reception;

F.         A bus tour of Hollywood for two;

G.        Two tickets to the non-broadcast Wheel of Fortune show and a chance to be randomly selected to participate in that show;

H.        A “Spin to Win” event in which the trip winner will spin the Wheel of Fortune for a chance to win an additional prize ranging from $300 (three hundred dollars) up to $2,500 (two thousand, five hundred dollars);

I.          The Wheel of Fortune VIP Trip does not include: mileage, insurance, gratuities, meals, parking fees, baggage fees, alcoholic beverages, travel to the airport of initial departure, and any items not expressly specified, including personal expenses such as telephone calls, valet service, laundry, incidentals and the like, and revision or cancellation fees which may be charged by the hotel or other suppliers;

J.          The trip winner or guest(s) must have a valid credit card or shall be required to post a cash deposit for incidentals to check in to the hotel. The Nebraska Lottery or IGT will not be responsible for charges or damages incurred by any trip winners or guests;

K.        If the trip winner is traveling via air and fails to appear at the designated time and place of departure (excluding flight delays), the trip winner shall be responsible for transportation to the specified destination at his or her own expense;

L.         If the trip winner is traveling via air and fails to appear at the designated time and place of departure (excluding flight delays), and does not find alternate transportation as described above in K, unless otherwise specified by the Nebraska Lottery, a proxy may be chosen to play for the absent winner, and any prize won as a result of such proxy’s shall be awarded to the absent trip winner;

M.        The trip winner is solely responsible for the actions of the guest who accompanies the trip winner to the event;

N.        Wheel of Fortune VIP Trips will be scheduled for January or February 2017;

O.        State and federal taxes shall be withheld and reported by the Lottery for the 2016 tax year and a Federal Form W-2G will be provided to the prizewinner on approximately January 31, 2017. Any person claiming a trip prize shall be responsible for any additional federal and state income taxes on the prize as required by law;

P.         State and federal taxes shall be withheld and reported by IGT for any cash prizes that may be won during the Lottery-Player only, non-broadcast show in Los Angeles for the 2017 tax year and a Federal IRS Form W-2G will be provided to the prizewinner on approximately January 31, 2018. Any person claiming a trip prize shall be responsible for any additional federal and state income taxes on the prize as required by law; and

Q.        A Wheel of Fortune VIP Trip winner may assign a proxy to attend the event and play for any prizes for the actual trip winner. If a proxy is assigned, the proxy will be subject to all terms and conditions that apply to the VIP trip.

4.         Emergency Termination:

4.1       If, for any reason, all or any part of the second-chance promotion does not run as planned due to, without limitation, errors in these official rules or advertising for this promotion, tampering, unauthorized intervention, fraud, technical failures, human error, or any other cause beyond the control of the Nebraska Lottery that, in the sole judgment of the Nebraska Lottery, could corrupt or affect the administration, security, fairness, integrity, or proper conduct of this promotion, the Nebraska Lottery reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the promotion.

5.         Eligibility and Entry:

5.1       The Nebraska Lottery’s Wheel of Fortune Second-Chance Promotion is only open to individuals 19 years of age or older.

5.2       To participate, an individual must access their MVP Club membership at nelottery.com and enter ticket information via a linked website supported by IGT. Players may only enter online. Entry steps are as follows:

a)         To enter, players must go to nelottery.com to submit the ticket number and the four-digit box code from an eligible Scratch ticket via a linked website supported by IGT. Players may only enter online. A player may enter multiple times, but each ticket can only be entered once. Each ticket entered will generate a single entry. The actual tickets from which numbers are submitted must be retained for prize verification.

b)         Every single, non-winning Wheel of Fortune Scratch ticket may only be entered once and may only be entered from Monday, April 25, 2016, through Tuesday, August 9, 2016.

c)         For each entry of a non-winning Wheel of Fortune Scratch ticket, a player will receive one entry into the second-chance promotion and be awarded one (1) Wheel of Fortune “Solve a Puzzle” game opportunity. Players will have a chance to solve puzzles against a time limit. The “Solve a Puzzle” game is a play-for-fun feature--no prizes will be awarded.

5.3       The Nebraska Lottery must be able to contact the semifinalists by, at the option of the Nebraska Lottery, the phone number, address, or email address provided at the time of entry. After the semifinalist selection, the Nebraska Lottery will contact the semi­finalist and mail the semifinalist a claim form. The name and other information provided on the claim form must match information provided at the time of entry except that, pursuant to Lottery Regulation 502.03, the person who signs or who places their name in the designated area of the ticket shall be considered the owner of the ticket, notwithstanding any of the above. Proof of identification will be required at the discretion of the Nebraska Lottery to include, but is not limited to, a photocopy of a valid driver’s license or other state issued identification, valid military identifica­tion, or valid passport. If any of these criteria are not met, the prize cannot be claimed and another semifinalist will be chosen.

6.         Entry Rules and Regulations:

6.1       During the promotion, any non-winning Wheel of Fortune Scratch ticket can be entered through a player’s MVP Club membership. Players will receive one (1) entry for each submission of a Wheel of Fortune Scratch ticket number and the four-digit box code entered through the Nebraska Lottery website by the deadlines listed in section 7.1. Players must keep the entered Scratch tickets for verification. See nelottery.com for more details.

6.2       The Nebraska Lottery will not accept entries at any of its claim centers or retail locations.

6.3       A player may enter multiple times, but an individual Scratch ticket number may only be entered once.

6.4       An individual may only be selected once as a semifinalist.

6.5       Attempts will be made by the Nebraska Lottery for one week after the drawing to contact each of the semifinalists by telephone and/or email. The Nebraska Lottery may utilize alternative methods to contact the semifinalists at the Nebraska Lottery’s discretion. If a semifinalist fails to respond to contact attempts made by the Nebraska Lottery during the one-week timeframe, the semifinalist forfeits their prize and the Nebraska Lottery reserves the right to draw a new semifinalist.

7.         Prize Selection:

7.1       Three (3) separate drawings will be held as indicated in the chart below. Each drawing will be for the selection of three (3) semifinalist. Only qualified entries, as defined by these contest rules, that have been submitted via the IGT-supported website linked to nelottery.com will be eligible to be selected as a semifinalist. The semifinalists will be notified by telephone or email, when they will be asked to provide their mailing addresses for prize fulfillment. The Nebraska Lottery will use the email and other information provided at the time of entry. Three semifinalists will be drawn in each drawing.

7.2       The prizes are not exchangeable or otherwise transferable. Cash will NOT be awarded in lieu of a merchandise prize. Federal, state, or local taxes on any prize are the sole responsibility of the winner unless otherwise indicated in the prize section of the rules. 

7.3       All applicable federal, state, or local laws apply.

7.4       If applicable, prizes will be mailed to the winners at the address provided when contacted by the Nebraska Lottery by email or phone. If agreed upon with the contest winners, prizes can be picked up at the Nebraska Lottery office located at 1800 “O” Street, Suite 101, Lincoln, Nebraska.

7.5       If a prize is returned to the Nebraska Lottery, the Lottery may declare the prize forfeited by the winner, and the winner will have no further right to the prize.

7.6       The winner’s entry and acceptance of a prize constitutes permission to use the winner’s name, photograph, or likeness for purposes of advertising, publicity, or promotion on behalf of the Nebraska Lottery. The name of the winner and town/city/state will be posted on the Nebraska Lottery Facebook or Twitter page following winner notification.

7.7.1    Pursuant to Neb. Rev. Stat. § 9-810(5), prior to the payment of any lottery prize in excess of $500 for a winning lottery ticket presented for redemption to the Nebraska Lottery, including the applicable prizes provided in this promotion, the Nebraska Lottery shall check the name and Social Security number of the winner with a list provided by the Nebraska Department of Revenue of people identified as having an outstanding state tax liability, and a list of people certified by the Nebraska Depart­ment of Health and Human Services as owing a debt as defined in section 77‑27,161. The Nebraska Lottery shall credit any such lottery prize against any outstanding state tax liability or certified debt owed by such winner and the balance of such prize amount, if any, shall be paid to the winner by the Nebraska Lottery. Any such credit of a lottery prize against a state tax liability or certified debt is collectively referred to as an “offset.” With regard to non-cash prizes, offsets shall be applied in the manner prescribed by Lottery Regulation 604.14 through 604.14C.

 

7.7.2    In regard to merchandise prizes, if the state tax liability or certified debt is greater than the cash prize amount, the Nebraska Lottery will provide a substitute prize for the merchandise prize. The substitute prize will be a cash amount determined by the Nebraska Lottery, in its sole discretion, which amount will not be subject to appeal by the prizewinner and will not include the value of any state or federal tax (collectively referred to as the “cash equivalent”). The cash prize amount and the cash equivalent will be credited against the state tax liability or certified debt and, if applicable, the remaining amount paid to the winner. As an alternative, the prizewinner may elect to pay the full amount of the state tax liability or certified debt in the amount and in the manner as determined by the Nebraska Lottery in its sole discretion. If the Nebraska Lottery determines the full amount of the state tax liability or certified debt has been paid in the manner as prescribed by the Nebraska Lottery, the prizewinner will receive the Grand Prize as detailed in the promotion.

7.8       Odds: Odds of winning depend on the number of entries received.

8.         General Contest Terms:

8.1       Only entries submitted by legally eligible players through the IGT-supported website and containing complete and valid information are eligible for this promotion contest.

8.2       Entries which are lost, late, incomplete, misdirected, or incompletely received, including by reason of technical malfunction, network congestion, or system incompatibility, are ineligible. Entries for this contest are entered via an IGT-supported website. The Nebraska Lottery is not responsible for entries which are lost, late, incomplete, misdirected, or incompletely received, including by reason of technical malfunction, network congestion, or system incompatibility.

8.3       Information provided to the Nebraska Lottery will be kept confidential, except as provided in 8.4, below, and will be used solely by or on behalf of the Nebraska Lottery, and will not be shared with or sold to outside parties without prior approval.

8.4       The drawing will be conducted by a computer random number generator program at Nebraska Lottery headquarters in Lincoln, Nebraska. The Nebraska Lottery will notify the contest winners. The identity of contest winners is public information pursuant to Neb. Rev. Stat. § 84-712.05(9) and Lottery Regulations and may be posted on the Lottery website and publicized by other means including, but not limited to, news releases and articles in the Nebraska Lottery players digest and retailer newsletter.

8.5       Prizes awarded in this and any other promotional contest conducted by the Nebraska Lottery are taxable income and may be reported for tax purposes. Winners of prizes over $500 in value will be checked for outstanding tax and child support liabilities to credit prize awards in accordance with state law. Prizes over $5,000 in value will automatically have state and federal income tax of 5 percent and 25 percent, respectively, withheld in accordance with state and federal law.

8.6       Prizes won in this contest are not transferable and, unless otherwise stated in the contest rules, may not be assigned except by judicial order.

8.7       IGT is solely responsible for Wheel of Fortune VIP Trip prize fulfillment. The Nebraska Lottery is not responsible for any travel, lodging, meals, or other expense related to claiming any prize. Non-cash prizes may not be exchanged or redeemed for cash value. Prizes consisting of lottery tickets will be mailed to Nebraska addresses only. Out-of-state winners may pick up lottery ticket prizes at a Nebraska Lottery claim center location by arrangement.

8.8       Participants must be 19 years of age or older to enter this contest. Employees of the Nebraska Lottery and its contractors, subcontractors, and their immediate family members residing in their same households are ineligible.

8.9       Nebraska Lottery MVP Club membership entitles one to receive information concerning Nebraska Lottery products and promotions according to the member’s stated preferences. MVP Club members may modify their member profiles at any time by following the directions on the MVP Club member login page on the Nebraska Lottery website at nelottery.com.

8.10     The actual tickets from which numbers are submitted must be retained for prize verification and received by the Lottery, along with a valid claim form. The Lottery is not responsible for lost, stolen, mis-delivered, damaged, illegible, or incompletely received tickets or claim forms.

8.11     Contest rules, drawing dates, deadlines, and procedures are subject to change without notice as may be deemed necessary or appropriate by the Nebraska Lottery in its sole discretion. By entering this contest, all participants agree to be bound by Nebraska state law and the rules and regulations of the Nebraska Lottery, including these promotion rules.
